GENERAL TERMS & CONDITIONS
These General Terms & Conditions (hereafter referred to as the GTCs) are a legal agreement between Balades Photographiques hereafter referred to as the “Supplier” and the client regarding any purchased experience. Balades Photographiques’ registration number: 81390905800030. These GTCs apply to any and all experiences offered by Balades Photographiques and mentioned on the website: www.baladesphotographiques.com. Balades Photographiques is fully entitled to modify its GTCs at any time and is committed to update the changes on its website.
1. SCOPE OF WORK
Balades Photographiques offers photography experiences, which are all detailed on the website: www.baladesphotographiques.com. By booking a photography experience, the client automatically accepts these GTCs, except where any specific condition is agreed between the Supplier and the client. The GTCs form an indivisible agreement, which the client must fill in, sign and send back by email to the Supplier before the photo session occurs.
2. BOOKING A PHOTO SESSION
The client can confirm and book a photo session over the phone (mobile +33 6 52 91 27 91) or by email: contact@baladesphotographiques.com
The booking can be confirmed at any time depending on the client and supplier's availabilities until one week prior to the photo session. Last minute bookings can be accepted but have to be discussed and agreed with the photographer at the first place. The reservation is confirmed by the Supplier once a 50 % deposit is paid online by credit card or bank transfer to the Supplier via a link sent to the client.
3. THE PHOTO SESSION
Clients must arrive on time and respect the agreed schedule. All information regarding the photo session i.e. meeting point will be sent by the Supplier prior to the session by email. More general information regarding photo sessions can be found here: FAQ. Unless otherwise agreed, the photo session will take place outdoors for one hour (Paris, Versailles or Giverny). The client can request additional hours at extra charge to be paid on the day by cash according to the photographer’s availability.

THE PREMIUM COLLECTION

* 35 digital files retouched + hosted in a private gallery
* Photos printed on quality paper + sent over to your address (extra shipping cost)
* Designed album printed on quality paper (50 pages) + sent over to your address (extra shipping cost)
EXTRA COSTS (for specific locations)
* 100 EUR additional cost for a photo session at Château de Versailles (+ 20 km)
* 195 EUR additional cost for a photo session at Monet's Garden, Giverny (+ 75 km)
MISC
* Flowers, accessories & other props can be arranged before hand upon request at additional charge.
* All prices are valid on the day of the booking and are all taxes included.
5. PAYMENT
To proceed to the booking, a 50% deposit shall be paid online by credit card or bank transfer to the Supplier in order to secure such booking. All terms and conditions should be read carefully and signed before making the 50% deposit. The remaining payment shall be made on the day of the photo session by cash.
6. PHOTO DELIVERY
Photos are delivered between 7-15 working days and the client will be notified once ready. Photos shown in the private gallery are going through a post-production process that improves their color and adjust exposure and contrast for the best result. Only some of them (not all) will get a final retouch to get the perfect look and/or some special desired effect.
The photos will be hosted in a private gallery (accessible with a temporary password provided by the Supplier) where the client will be able to select and create a favorite list. The number of photos chosen depends on the selected pack. From the time the link is sent, the client has seven calendar days to create the favorite list. Once the Supplier has received the favorite list, a pin number will be sent to the client to download all the selected photos in high resolution and in the appropriate format. Raw format photos are never delivered to the client. Once the pin number has been provided, the client has three days to download the selected photos; after that period of time, the link to access the private gallery will be removed.
Balades Photographiques will not be responsible for any loss or damage of the digital images. Request for duplicate formats will be charged to the client. The photos taken as well as the post-treatment are part of the photographer's style and artistic choice that will reflect his online portfolio that the client would have seen before. Any new photo edits proposed by the client and agreed by the photographer will be charged additionally to the client.
6. CANCELLATION
Once the booking of a photo session is made, it becomes effective. When there is a no show by the client, the 50% deposit will not be reimbursed.
7. FORCE MAJEURE & SICKNESS
In case of force majeure or sickness prior to the photo session, the Supplier may cancel the photo session. The cancellation cannot involve responsibility of the Supplier nor result in lawsuits. The supplier commits to use best efforts to propose other dates to the client or to another reliable photographer to cover the photo session. However, the photographer cannot be held responsible if the client were not happy with the style or quality of the photos delivered.
8. TECHNICAL PROBLEM OR ACCIDENT
If a technical problem or accident (case of force majeure) affects the Supplier during the photo session that will prevent the Supplier to perform its job, the amount of the deposit paid to secure the booking will be refunded to the client and cannot result in lawsuits. In case of technical computer issue, the delivery of the photos can be delayed and the client will be notified accordingly.
9. RESPONSIBILITY
Balades Photographiques cannot be held responsible for any loss, damaged or stolen personal belongings of the client that may occur during the photo session. The client and any accompanying persons there is responsible for keeping his belongings.
10. INTELLECTUAL PROPERTY
The content of the site www.baladesphotographiques.com is the property of Balades Photographiques and is protected by French and international laws regarding intellectual property. The whole content of the internet site and editorial, graphics, logo, brand and photos belong to Balades Photographiques and any copy, translation of any of the site content is totally forbidden. Copyright and related rights protect the use of photos during a session. Copyright and intellectual property rights of the 11 March 1957 law protect French Photographers. The delivery of the digital files assigns the right to digital reproduction on all support and format only within the private and family area. The client shall respect the moral rights over the photographer's work. Balades Photographiques has the right to use the photos taken during a photo session in order to promote its activities (unless otherwise expressly notified by the client in writing prior to the photo session)
The client authorizes the company Balades Photographiques to use freely the pictures in which the client appears without asking any income or copyright for the following usage:
* Portfolio
* Website
* Social media
* Marketing & Communication support (prints, flyers, books, name cards, etc.)
The photos taken as well as the comments linked to images should not strike a blow to the client's image or reputation.
The client should support the Supplier in case:
* A third party uses the photos in an abusive way
* Ask permission for any commercial use
10. ARCHIVE OF DIGITAL FILES
The Supplier commits to keep the digital files at least one year from the date of the photo session (except if an accident occurs that cannot involve the supplier's responsibility: fire, flooding, damaged hard drive, etc.… (force majeure). After this period of time, the supplier may destroy the files any time.
11. MODIFICATIONS OF GENERAL TERMS & CONDITIONS
Balades Photographiques is entitled to modify its GTCs at any time and is committed to update the changes on its website. The modifications will apply to any booking made after the modifications' date.
12. CLIENTS PRIVATE DATA
The supplier commits to preserve its clients private life and its visitors' on www.baladesphotographiques.com
13. APPLICABLE LAW
All photo sessions' assignments are subject to French law. For any dispute regarding this GTCs, only French courts shall be the competent authorities.
